By visiting our site or purchasing from us, you agree to be bound by these Terms of Service, including the additional policies referenced here (Refund Policy, Shipping Policy, Privacy Policy). If you do not agree, do not use the site or purchase our products.

We reserve the right to update these terms at any time by posting changes to this page. Continued use of the site after changes are posted constitutes acceptance.

1. Eligibility

You must be at least 18 years of age to use this site or purchase our products. By placing an order, you confirm you are 18 or older.

2. Products and intended use

Power-Up is a fitness and training device for pelvic floor muscle exercise. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Content on this site, including references to published research, is provided for general educational purposes only and is not medical advice. It is not a substitute for consultation with a qualified healthcare provider. If you have a medical condition, are recovering from surgery, experience pain during use, or have any concerns about pelvic floor training, consult a physician before use. Discontinue use immediately if you experience pain or discomfort.

Individual results vary. References to clinical research describe findings from published studies of pelvic floor exercise generally and are not a promise of specific outcomes.

3. Safe use

You are responsible for using the product as directed in the included training materials. Do not exceed the recommended resistance progression, session duration, or frequency. The product is intended for individual use only and should be cleaned before and after each use as directed.

4. Orders, pricing, and payment

All prices are listed in USD unless otherwise stated. We reserve the right to refuse or cancel any order, limit quantities, and correct pricing or descriptive errors, including after an order is submitted (with a full refund if already charged). Payment is processed at checkout through our payment providers; we do not store your full card details.

5. Digital content

Purchases that include digital training materials (training library, programming, tracking tools) grant you a personal, non-transferable license for individual use. You may not reproduce, distribute, resell, or publicly post these materials.

6. Intellectual property

All site content, including text, product design, training programs, graphics, and trademarks, is the property of Power-up, LLC or its licensors and is protected by applicable intellectual property laws. You may not use it without prior written permission.

7. Prohibited uses

You may not use the site or products for any unlawful purpose; to infringe our or others' intellectual property; to transmit malicious code; to scrape, harvest, or collect data from the site; or to interfere with the site's operation or security.

8. Third-party links

The site may reference or link to third-party content, including published research. We are not responsible for third-party content and provide such references for information only.

9. Disclaimer of warranties

Except as expressly provided in our Refund Policy (including the 30-Day Performance Guarantee), the site and products are provided as is and as available without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Power-up, LLC and its members, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Power-up, LLC from any claim arising out of your breach of these terms or your misuse of the site or products.

12. Governing law and disputes

These terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Wayne County, and you consent to their jurisdiction.
